By creating an account or using Bubu (the "App"), you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years old and the parent or authorised caregiver of any child whose data you enter.
Bubu lets you track your baby's activities, growth, and health-related information, share that data with family members you invite, and generate reports. The App is a personal tracking and organisation tool.
Bubu does not provide medical advice, diagnosis, or treatment, and is not a medical device. Growth percentiles, temperature labels, predictions, estimates, summaries, and reports are informational only and are not a clinical assessment. Always consult a qualified healthcare professional for medical decisions. If your child may be seriously ill, or you believe there is an emergency, contact your doctor immediately or call your local emergency number (for example 112 in the EU). Subject to Section 12.4, we are not liable for any health decision made based on the App.
Assumption of risk. Bubu is a personal record-keeping and organisation tool. It is not a medical device and not a monitoring, alerting, or emergency service. It does not observe your child, does not detect or warn of any medical condition, and will not notify you or anyone else of any risk. You are solely responsible for the care of your child and for any decision you make, and you accept the risks of relying on information you choose to record or view in the App. In an emergency, contact your local emergency services.
Indemnity. To the extent permitted by applicable law, and except to the extent caused by us, you agree to hold us harmless from any third-party claim or resulting loss arising from (a) your unlawful use of the App, (b) content or personal data you enter or share that you had no right to enter or share, or (c) your breach of these Terms. Nothing in this clause requires you to cover our own negligence or wrongdoing, and it does not affect your mandatory rights as a consumer.
When you invite another caregiver to your family, you decide who is invited and what they can access, and you are responsible for those invitations and for removing access when it is no longer appropriate. Invite only people you trust with your child's information. Bubu cannot verify the relationship between caregivers and cannot mediate or resolve disputes between them, including disputes arising from separation, divorce, or custody. If you no longer want a caregiver to have access, you may remove them, or delete a family you own, at any time in the App — this is your remedy, and we are not responsible for how a caregiver you invited uses information while they have access. If you have a safety concern (for example, abuse or an unsafe individual), remove their access and contact the appropriate local authorities; Bubu is not an emergency service.
Digital content and right of withdrawal. Premium is digital content supplied immediately. If you are an EU/EEA consumer you normally have a 14-day right of withdrawal for digital purchases; by starting your subscription or purchase you ask us and Apple to begin supplying the content immediately and you acknowledge that you lose the 14-day right of withdrawal once supply has begun. This does not affect your right to cancel an auto-renewing subscription for future periods at any time in your Apple ID settings, or your statutory rights if the content is faulty.
You own the data and photos you add. You grant us only the limited rights needed to store, sync, and display your content to you and the family members you invite. We do not claim ownership and do not use your content for advertising. You can export your data (CSV) and delete your account and all its data at any time from within the App, free of charge.
You may stop using the App and delete your account at any time (Settings → Account → Delete Account). We may suspend accounts that violate these Terms.
If you have a problem, please contact us first at bubu.support@gmail.com and we will try to resolve it. If you are a consumer resident in the EU/EEA, nothing here affects your right to bring proceedings in the courts of your country of residence, or to use any alternative dispute resolution (ADR) or consumer-mediation body available to you under local law. Romanian consumers may also contact the National Authority for Consumer Protection (ANPC, anpc.ro).
12.1 "As is." The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, or non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any data, percentile, estimate, summary, or report is accurate, complete, or reliable. You use the App, and rely on any information it produces, at your own discretion and risk.
12.2 Exclusion of certain damages. To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, goodwill, or data, arising out of or relating to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
12.3 Cap on liability. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the App or these Terms shall not exceed the greater of (a) the total amount you paid to us for the App in the twelve (12) months before the event giving rise to the liability, or (b) EUR 50.
12.4 Rights that cannot be excluded. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intentional misconduct, and any liability or mandatory consumer right that cannot be excluded or limited under the law of Romania or the mandatory law of your country of residence in the EU/EEA — including your right to a digital service that conforms to the contract under EU Directive 2019/770 as transposed in your country. If any limitation in this Section 12 is found unenforceable, it applies to the fullest extent permitted by law and the remaining provisions stay in effect.
We may update these Terms from time to time. For minor changes, the updated Terms take effect when posted, shown by the "Last updated" date. For any material change, or any change affecting a paid subscription, we will give you reasonable advance notice in the App and, where the law requires, obtain your consent or give you a right to cancel before the change takes effect. If you do not agree to a change, you may stop using the App and cancel or delete your account. Continuing to use the App after a change has taken effect means you accept the updated Terms.
These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer-protection rights you have under the law of your own country of residence in the EU/EEA. Contact: bubu.support@gmail.com
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be applied to the greatest extent permitted by law or, if it cannot be, severed. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets, without reducing your rights.
